Weekly Legal Updates for Law Entrance Exams (22nd-31st August 2019)

In this post we have covered the Legal updates of the fourth week of August (22-31). "Weekly Legal Updates" series aims to provide important legal events and developments. These updates will help aspirants appearing for Law Entrance Exams.

Weekly Legal Updates

1. The Supreme Court has referred all the petitions challenging the scrapping of Article 370, which gave special status to Jammu and Kashmir, to a five-judge Constitution Bench. Thus a bench of 5 judges of the Supreme Court will hear the challenge to the scrapping of Article 370.

  • The present petition challenges the Presidential Order of August 5, 2019, introduced to supersede the Constitution (Application to Jammu & Kashmir) Order, 1954, which stated that the Constitution of India that would not apply to Jammu and Kashmir.
  • The Presidential Order of August 5 also paved the way for the introduction of the Jammu & Kashmir Reorganisation Act, 2019 which bifurcated the State of Jammu and Kashmir into two Union Territories - Union Territory of Jammu & Kashmir, and Union Territory of Ladakh.

2. A Writ Petition has been filed before the Supreme Court under Article 32 of the Constitution challenging the restrictions imposed on the media in Jammu and Kashmir. This petition aims to seek a direction from the court to relax the restriction on mobile, internet and landline services and the strict restriction imposed on freedom of movement in the valley.

3. Chief Justice V Ramasubramanian of the Himachal Pradesh High Court, Chief Justice Krishna Murari of the Punjab & Haryana High Court, Chief Justice S Ravindra Bhat of the Rajasthan High Court, and Chief Justice Hrishikesh Roy of the Kerala High Court have been recommended for appointment as Supreme Court judges by the Supreme Court collegium.

4. Himachal Pradesh legislature passes Himachal Pradesh Freedom of Religion Bill, 2019 to prohibit forced religious conversion. The law enacted states “Marriage which was done for the sole purpose of conversion may be declared null and void by the Family Court on a petition presented by either party.”

5. Supreme Court has held that it mandatory for institutions intending to impart technical courses through distance learning mode to seek approval and recognition of University Grants Commission (UGC) and All India Council for Technical Education (AICTE).
