Weekly Legal Updates for Law Entrance Exams (8th-14th September 2019)

In this post, we have covered the Legal updates of the second week of September (08-14). "Weekly Legal Updates" series aims to provide important legal events and developments. These updates will help aspirants appearing for Law Entrance Exams.

Weekly Legal Updates

1. Eminent Jurist, Senior Advocate and former Union Law Minister Ram Jethmalani passed away. Jethmalani challenged the imposition of emergency by Indira Gandhi before the Supreme Court. Jethmalani has also appeared for two persons who were accused of killing Indira Gandhi.

Note:

  • Ram Jethmalani was also a chairman of the Bar Council.
  • In 1996, he became Law Minister in the government of Atal Bihari Vajpayee.
  • In the second term of the Atal Bihari Vajpayee government, he was given the Ministry of Urban Development.
  • He was born on September 14, 1923.
  • At the age of 17, Jethmalani had taken a law degree.
  • Jethmalani fought the first case of KM Nanavati vs Government of Maharashtra in 1959 and he became quite famous.
  • In this, Jethmalani fought the case with Yashwant Vishnu Chandrachud and later Chandrachud became the Chief Justice of the country.
  • Yeshwant Vishnu Chandrachud was the 16th Chief Justice of India, serving from 22 February 1978 to the day he retired on 11 July 1985.
  • Y.V. Chandrachud is the longest-serving Chief Justice in India's history at 7 years and 4 months. 

2. Prime Minister of UK Boris Johnson's decision to suspend the UK Parliament for more than a month has been ruled unlawful by Scotland's highest court of appeal. Thus, the Court held that the advice given by the Government to Her Majesty, The Queen, to prorogue Parliament from 9th September to 14th October is unlawful.

3. The National Green Tribunal (NGT), Delhi has directed the Agra Development Authority to clear the flood plain of the river by ensuring removal of all encroachments by 31st March 2020. Justice Adarsh Kumar Goel is the present chairperson of the National Green Tribunal.

4. The High Court of Jammu and Kashmir has allowed two Members of Parliament belonging to the J&K National Conference to meet  Farooq Abdullah and Omar Abdullah who are under house arrest, few restrictions namely that the two MPs are prohibited from interacting with the media after the meeting with the party leaders.

5. The Supreme Court has referred the review petition preferred by the Central Government against the Supreme Court judgment diluting provisions of SC/ST (Prevention of Atrocities) Act, 1989 to a larger Bench.

  • In 2018, the Supreme Court had introduced safeguards to prevent misuse of the SC/ST Act against officers who deal with the complaints under the Act in their official capacity.
  • It had held that prior sanction of the appointing authority is required for prosecuting officers for acts done by them with respect to the SC/ST Act in their official capacity. The judgment had resulted in backlash from the SC/ST community. Thus, a review petition is preferred by the Central Government.
